Ontario - New Short Term Suspension Law
On May 1st, 2009 Ontario changed its drinking and driving laws. Effective 1 May 2009 any driver caught drinking and driving above .05% BAC, but below the criminal limit of .08% BAC, will receive a short term suspension. Short term suspensions will be administered as follows:
- 3 days for a first instance
- 7 days for a second instance (plus requirement to take a remedial measures program)
- 30 days for a third instance (plus requirement to take a remedial measures program and have ignition interlock installed for 6 months)
In addition to the above sanctions, drivers face the possibility of having their car towed and impounded – costs of which are paid by the driver. As well, all drivers will have to pay a $150 administrative fee for reinstatement of their suspended license. And if that wasn’t bad enough, these new low BAC infractions will be tracked and visible on your driver’s abstract.
