The Law
Under Common Law, Commercial Hosts have an active duty of care to intoxicated patrons to ensure they do not cause injury to themselves or others upon leaving the premises. In addition, under Statutory Law (Liquor License Act), Commercial Hosts have an active duty of care to recognize and prevent intoxication. Therefore, while under Common Law, Commercial Hosts may satisfy their duty by putting an intoxicated person in a cab, this will not prevent liability under Statute Law because once a Commercial Host has served an apparently intoxicated person, they have breached their duty.
Today, the assessment of intoxication is reliant upon the judgment of servers who have been Smart Serve trained and their ability to apply the basic mathematical principles of the pharmacology of alcohol. Such knowledge is power and, as such, the knowledge provided by the Smart Serve Program assists Commercial Hosts to mitigate their liability. However, applying this knowledge consistently and effectively in an actively social environment can be challenging.
Utilizing Ladybug's Know Your AQ™ Event service enables Commercial Hosts to further mitigate their liability as there now exists an objective assessment of intoxication and a clear course of action for their Smart Serve servers to implement. When teamed with a collaborative multi-party solution, Know Your AQ Event service enables Commercial Hosts to demonstrate a well thought-out and comprehensive program of guest safety.
